R.I.P. Habeus Corpus

Human has an excellent take on this. I'll let him take it on; I'm too busy feeling sick to my stomach. . .Okay, maybe I DO have a few things to say about it:

If THIS doesn't give you cause to vote these bastards out of power in November than nothing ever will. This summer the Supreme Court ruled that these measures, which are now about to become law, were unconstitutional. So, apparently, the Supreme Court is only useful to these people when "choosing a president" or denying women their personal rights, or whatever their agenda of the day may be. See what happens when you give Republicans control over ALL branches of our government??? BTW,there are 12 Democrats that I would also like to speak with about this issue. . .

Now is truly the time for all good men (and women) to come to the aid of their country!

If the Dems were so limp wristed...I imagine the voters will be the same. I think people just have too much going on in their lives to give a crap about much of anything. So don't be too expectant of the voters...you'll probably go nutters...or something over it...I know I will.

John, humans take (and yours) on this issue is fascinating, but intellectually dishonest. He uses the word YOU over and over again. As a U.S. citizen, YOU haven't lost a thing. If you are a NON-U.S. citizen, captured in battle then you have lost your rights and will be detained. Our rights have not been affected one iota.

Not to worry, all the child molesters and axe murderers in THIS country still have more rights than their victims do.

And you say the repubs use fear to sway opinion?

Tim - Again missing the bigger picture. If an American soldier (US citizen) is captured, other countries can now legally subject him or her to the same treatment.

I am shaking over this. And my own DEMOCRATIC congressman, Dennis Moore, voted for this BS!! He is getting one NASTY e-mail from me when I have calmed down a bit.

Will using various curse words in an e-mail to a congressperson get one in serious trouble?

John,The picture is a little bigger than you are able to see. If our guys are captured, it will make no difference at all.Do you honestly believe our enemies won't torture and kill them (like they already have) anyway?

This isn't some minor philosophical disagreement between coutries, it's a war and they play by NO rules. In my opinion we ARE taking the moral highground by not slitting their throats.....

Nicely said John.

They're not just circumventing the constitution any more. They're breaking and changing it. This is why the Geneva Convention means nothing to the LIAR and his crime syndicate.

I haven't even looked at the list of 12 yet. I don't need to be more pissed, but I'm guessing they're some of the same members of the Appeasement 19.

We've got about six weeks left and now is not the time to let up for one second. The first item on the agenda for the new congress should be Articles of Impeachment.

Point of order Tim...

If an American Citizen is labeled an enemy combatant, they lose all their rights under this law.

So it isn't just the terrorists.

Anyway, since when do we not take the high road... instead go in to wallow in the mud as the worst of our enemies?

Hey Tim,

Make your argument to Jose Padilla - I'm sure he would find that very fascinating. The truth is this administration not only CAN but HAS labeled American citizens as enemy combatents.

Fearing an embarrassing loss in the courts, the Bush Administration finally (after 3 years) transferred Padilla from military to civilian authority. Unfortunately, since Padilla was transfered, the Supreme Court refused to hear his case allowing the Bush administration to continue to label American citizens as enemy combatents in the future.

So the argument is not intellectually dishonest whatsoever. The truth is, most on the right don't want to talk about Padilla or they just don't pay any attention while rubberstamping this administration's policies.

This administration and your party continues to trample over our rights while spitting on the US Constitution...

In this chapter: 3
(1) UNLAWFUL ENEMY COMBATANT.—(A) The term ‘unlawful enemy combatant’ means—
"(ii) a person who, before, on, or after the date of the enactment of the Military Commissions Act of 2006, has been determined to be an unlawful enemy combatant by a Combatant Status Review Tribunal or another competent tribunal established under the authority of the President or the Secretary of Defense."

Subsection 4(b) (26) of section 950v. of HR 6166 - Crimes triable by military commissions - includes the following definition.

"Any person subject to this chapter who, in breach of an allegiance or duty to the United States , knowingly and intentionally aids an enemy of the United States, or one of the co-belligerents of the enemy, shall be punished as a military commission under this chapter may direct."

I also have updated with pertinent quotes from President Jefferson and PM Churchill.

I have written about Jose Padilla several times in the last couple of years.

This whole idea of declaring an American citizen an "enemy combatant" and arresting them in AMERICA and then removing their access to the court system is wrong.

The Jose Padilla case is EXTREMELY SHAMEFUL. They did finally charge him; however they are not charging him with ANY of the crimes he was arrested for...

I for one certainly hope the Democrats take over at least The House or the Senate.

We need gridlock...

Tim has no answer for Padilla. And Tim's version of the moral high ground is neither moral nor high. Tim believes we should ignore the Constitution. He believes the Fourth Amendment is open to interpretation. He sees nothing wrong with violating the Constitution. Much like when Bush said the Constitution was "just a goddamn piece of paper", Tim is one of those people who will only rely on the Constitution when it backs up his argument.

Another document, The Declaration of Independence said, "We hold these Truths to be self-evident, that all Men are created equal, that they are endowed, by their Creator, with certain unalienable Rights, that among these are Life, Liberty, and the Pursuit of Happiness." You will notice that it says ALL MEN, it doesn't say ALL MEN BORN IN THE UNITED STATES.

We need to set examples for others to follow, not set examples for others to loath. How difficult is that for any sensible and compassionate person to understand. Once again showing that Bush never intended to be a "Compassionate Conservative".

These Neoconvicts and their blind sheep annoy me. John, one of our mutual friends just wrote us that "Many politicians leave office because of illness and fatigue: people become sick and tired of them." Amen!
